In accordance with the Mongolian Stock Exchange /MSE/ “Securities registration order” chapter four, securities issuer criterion and registration code are set annually for the listed joint stock companies. However, with the assistance of the Mongolian Financial Regulatory Commission, securities issuers that are unable to meet the criteria are abolished from the list. Based on the year 2009 and 2010 performance, securities issuer law and code are evaluated in accordance with the contractual obligation, moreover, enacted the securities issuer criterion. The criterion performance indicates that the 86% or 288 joint stock companies out of MSE listed 336 joint stock companies failed to meet the securities registration criterion. In the first round, those companies which consecutively have not complied with the criterion and have not met its shareholder or competent authoritys contractual obligation issue should be resolved. For instance, since 1996 those who have not held shareholders meeting, have not submitted financial statements, havent paid the registration fee for many years, and those with fragile share price. The Mongolian Stock Exchange works towards standardizing the listed securities and ensuring listed companies fulfillment of its legal duties. Therefore, the operations of below listed 72 joint stock companies which have not met the standard and criterion in order to protect the right of shareholders will be terminated; in addition, they will be reported to the Mongolian Financial Regulatory Commission. Consequently, the MSE is announcing, by 24th of March 2011, the below mentioned joint stock companies legal administrators, management and major shareholder are to comply with the regulation and contractual obligations. Furthermore, they shall submit liable explanation and documents to the registration department of the MSE.
